Terms of Service

Please read these Terms of Service carefully before using the ListingGPT Pro platform.

1. Agreement to Terms

By accessing or using the ListingGPT Pro platform ("Platform"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and ListingGPT Pro ("we," "us," or "our"). By creating an account, subscribing to a plan, or otherwise using any features of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you are using the Platform on behalf of a business, brokerage, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and the entity you represent.

Last Updated: February 24, 2026. We encourage you to review these Terms periodically for changes. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of those changes.

2. Description of Service

ListingGPT Pro is an AI-powered real estate marketing platform designed to help real estate professionals create high-quality marketing content efficiently. Our Platform provides the following services:

  • Listing Descriptions: AI-generated property listing descriptions optimized for MLS, websites, and marketing materials.
  • Social Media Content: Platform-specific social media posts for Instagram, Facebook, LinkedIn, and other channels.
  • Email Campaigns: Professional email marketing content for buyer outreach, open house invitations, and drip campaigns.
  • Marketing Graphics: AI-assisted design tools for creating branded marketing materials and property flyers.
  • Content Calendars: Automated social media and marketing content scheduling and planning tools.
  • Photo Enhancement: AI-powered photo editing, virtual staging, and image optimization for property listings.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

3. Account Terms

To access and use the Platform, you must create an account. By creating an account, you agree to the following terms:

  • Age Requirement: You must be at least 16 years of age to create an account and use the Platform. By registering, you represent and warrant that you meet this age requirement.
  • Accurate Information: You must provide accurate, current, and complete information during registration and keep your account information up to date. Providing false or misleading information may result in immediate account termination.
  • Account Security: You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately of any unauthorized access to or use of your account.
  • One Person Per Account: Each account is intended for use by a single individual. Sharing accounts between multiple users is prohibited. If you require multiple users, each must create their own account.
  • No Credential Sharing: You must not share your login credentials (email, password, API keys, or authentication tokens) with any other person or entity. You are responsible for all activity that occurs under your account.
  • Account Suspension: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are used in a manner that threatens the security or integrity of the Platform.

4. Subscription and Payment

4.1 Free Trial

New users are eligible for a free 7-day trial period. Upon expiration of the trial, your account will automatically convert to the Essential plan. You may cancel at any time during the trial period to avoid being charged.

4.2 Payment Processing

All subscriptions and payments are managed and processed through Stripe, our PCI DSS Level 1 certified payment processor. By subscribing, you agree to Stripe's terms of service and authorize recurring charges to your designated payment method.

4.3 Cancellation

You may cancel your subscription at any time through your Account Settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your billing cycle.

4.4 Refund Policy

No refunds are provided for partial months of service. All charges are non-refundable unless required by applicable law. For full refund policy details, please refer to our Refund Policy.

4.5 Pricing Changes

We reserve the right to change our subscription pricing at any time. You will receive at least 30 days' advance notice via email before any pricing changes take effect. Continued use of the Platform after a pricing change constitutes acceptance of the new pricing.

4.6 Failed Payments

If a scheduled payment fails, you will be given a 7-day grace period to update your payment information. If payment is not received within the grace period, your account will be suspended and access to paid features will be restricted until payment is resolved.

5. AI-Generated Content — Ownership and Responsibility

The Platform uses artificial intelligence to generate marketing content for real estate professionals. The following terms govern the ownership and use of AI-generated content:

  • User Input Ownership: You retain full ownership of all input data you provide to the Platform, including property details, photographs, descriptions, and any other information you submit.
  • AI Output as a Tool: AI-generated content — including listing descriptions, social media posts, email copy, and marketing materials — is provided as a tool to assist you in creating marketing content. The output is a starting point, not a finished product.
  • License to Use: You are granted a perpetual, non-exclusive, worldwide license to use, modify, reproduce, and distribute any AI-generated content created through your use of the Platform for your real estate marketing purposes.
  • No Ownership Claim: ListingGPT Pro does not claim ownership of AI-generated content produced through your use of the Platform.

Critical: User Responsibility for AI-Generated Content

  • You are solely responsible for reviewing and verifying all AI-generated content before publication. AI-generated content may contain inaccuracies, omissions, or errors that require human review and correction.
  • AI-generated content is provided "as-is" with no warranty of accuracy, completeness, or fitness for a particular purpose.
  • You must verify all property details, pricing, square footage, features, and claims in any generated content before using it in any listing, advertisement, or communication.

6. Fair Housing Act Compliance

Critical Legal Section — Please Read Carefully

This section addresses your obligations under the Fair Housing Act (42 U.S.C. §§ 3601–3619) and equivalent state and local fair housing laws. Violations of fair housing laws can result in significant civil penalties, lawsuits, and loss of real estate licensure.

  • AI Compliance Scanning: Our AI content generation includes built-in Fair Housing Act compliance scanning designed to identify and flag potentially discriminatory language before content is delivered to you. However, this automated scanning is a tool to assist — not a guarantee of compliance.
  • Ultimate Responsibility: You, as the real estate agent, broker, or professional publishing the content, bear the ultimate and sole responsibility for ensuring that all published content complies with the Fair Housing Act and all applicable state and local fair housing laws.
  • Prohibited Discrimination: You must not publish any content — whether AI-generated or otherwise — that discriminates based on race, color, national origin, religion, sex (including gender identity and sexual orientation), familial status, or disability.
  • Review Obligation: You must review all AI-generated content for potentially discriminatory language, exclusionary descriptions, or steering language before publication on any platform, MLS, website, or marketing material.
  • No Liability: ListingGPT Pro is not liable for any Fair Housing Act violations arising from content published by users, regardless of whether that content was generated, modified, or suggested by our AI tools.
  • Indemnification: You agree to indemnify, defend, and hold harmless ListingGPT Pro, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from or related to Fair Housing Act violations in content you publish.

7. Acceptable Use Policy

You agree to use the Platform in compliance with all applicable laws and regulations. The following uses are expressly prohibited:

  • Using the Platform for any illegal, unlawful, or fraudulent purpose.
  • Submitting false, fraudulent, or misleading property information to generate content.
  • Attempting to circumvent usage limits, rate limits, security features, or access controls.
  • Uploading copyrighted photographs, images, or other content without having the necessary rights or permissions.
  • Using the Platform to generate discriminatory, misleading, defamatory, or deceptive content.
  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or underlying technology of the Platform.
  • Using automated tools, bots, scrapers, or other software to access, interact with, or extract data from the Platform without our express written consent.
  • Reselling, sublicensing, or providing access to the Platform to third parties without our prior written authorization.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice or refund.

8. DMCA and Intellectual Property

ListingGPT Pro respects the intellectual property rights of others and expects our users to do the same. You represent and warrant that you have the legal right to upload, submit, and use all photographs, images, text, and other content you provide to the Platform.

8.1 DMCA Takedown Procedure

If you believe that content on our Platform infringes your copyright, please submit a written notification to our designated DMCA agent at dmca@listinggptpro.com containing the following:

  • A description of the copyrighted work you claim has been infringed.
  • The URL or location of the allegedly infringing material on our Platform.
  • Your contact information, including name, address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  • Your physical or electronic signature.

8.2 Counter-Notification

If you believe that content you uploaded was removed or disabled as a result of an erroneous or misidentified DMCA takedown notice, you may submit a counter-notification to our DMCA agent. The counter-notification must comply with the requirements of 17 U.S.C. § 512(g).

8.3 Repeat Infringer Policy

In accordance with the Digital Millennium Copyright Act, we maintain a repeat infringer policy. Accounts that are the subject of three (3) or more valid DMCA takedown notices will be permanently terminated without refund.

9. Data Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

  • Regulatory Compliance: All data processing is conducted in accordance with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable data protection laws.
  • Data Deletion and Export: You may request deletion or export of your personal data at any time through your Account Settings or by contacting us at support@listinggptpro.com.
  • Grace Period: Upon account deletion, a 14-day grace period applies during which your data is retained in case you wish to reactivate your account. After the grace period, all data is permanently and irreversibly deleted.

10. Limitation of Liability

Important Legal Disclaimer

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

  • ListingGPT Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Platform.
  • Aggregate Liability Cap: Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount you paid to ListingGPT Pro during the twelve (12) months immediately preceding the event giving rise to the claim.
  • AI Content Accuracy: We are not liable for the accuracy, completeness, or reliability of any AI-generated content. You acknowledge that AI-generated content may contain errors, inaccuracies, or omissions.
  • Third-Party Services: We are not liable for interruptions, outages, or failures of third-party services integrated with the Platform, including but not limited to Stripe, OpenAI, and other service providers.
  • Data Loss: We are not liable for any data loss beyond the implementation of reasonable and commercially standard security measures. You are responsible for maintaining your own backups of critical data.

11. Indemnification

You agree to indemnify, defend, and hold harmless ListingGPT Pro, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:

  • Fair Housing Violations: Any Fair Housing Act violations or claims arising from content you publish, regardless of whether the content was generated, modified, or suggested by our AI tools.
  • Copyright and IP Claims: Any copyright infringement or intellectual property claims arising from photographs, images, text, or other content you upload to the Platform.
  • AI Content Usage: Any claims, damages, or liabilities arising from your use, publication, or distribution of AI-generated content.
  • Terms Violations: Your violation of any provision of these Terms of Service.
  • Third-Party Claims: Any third-party claims related to properties you list, market, or advertise using the Platform, including claims from buyers, sellers, or other parties.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve any dispute informally by contacting us at legal@listinggptpro.com. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice.

12.2 Binding Arbitration

If a dispute cannot be resolved informally within 30 days, you and ListingGPT Pro agree that the dispute shall be resolved by binding arbitration, rather than in court, except as otherwise provided herein. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) and shall take place in the State of Delaware.

12.3 Class Action Waiver

YOU AND LISTINGGPT PRO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

12.4 Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.

12.5 Governing Law

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

13. Termination

  • Termination by You: You may terminate your account at any time by cancelling your subscription through your Account Settings. Termination does not entitle you to a refund for any prepaid fees.
  • Termination by Us: We may suspend or terminate your account immediately, without prior notice or liability, if you violate any provision of these Terms, engage in fraudulent or illegal activity, or otherwise pose a risk to the Platform or other users.
  • Data Retention Upon Termination: Upon termination, your data will be retained for a 14-day grace period to allow you to reactivate your account or export your data. After the 14-day period, all account data will be permanently and irreversibly deleted from our systems.
  • Surviving Provisions: The following sections shall survive termination of these Terms: Limitation of Liability (Section 10), Indemnification (Section 11), Dispute Resolution (Section 12), and any other provisions that by their nature should survive.

14. Modifications to Terms

  • Right to Modify: We reserve the right to modify these Terms at any time. You will receive at least 30 days' advance notice of any material changes via email to the address associated with your account.
  • Continued Use: Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform and cancel your subscription.
  • Material Changes: For material changes that significantly affect your rights or obligations, we will require your affirmative consent (e.g., checking a box or clicking "I Agree") before the changes take effect.
